Car ijara in Québec: leasing a vehicle until you own it

Car ijara is an Islamic lease in which the financier buys and keeps ownership of the car, rents it to you for a rent fixed in advance, then hands it over at the end through a separate sale or gift.

How ijara differs from a conventional car lease

In a conventional lease, the payment includes an implicit financing rate calculated on the price and residual value. In ijara, the financier leases an asset it genuinely owns and the rent pays for use, just as in home ijara.

A lessor that carries ownership risk

According to many scholars, the lessor must bear the risks of ownership, including total loss of the car without the lessee's fault. If the car is destroyed, rent should stop for the remaining period. Check how the contract handles this.

Routine maintenance and major repairs: who pays

Routine wear such as tires, oil changes and washer fluid usually falls on the lessee. Structural repairs belong in principle to the owner in classical ijara, but some contracts shift them through a separate service clause. Read that split before signing.

Insuring a car held under ijara

The financier requires insurance covering damage and theft, usually at your expense under a separate clause. With little takaful available in Canada, several scholars accept mandated conventional insurance; ask a qualified scholar.

How ownership passes to you at the end

Ownership cannot pass automatically under the same lease contract. Instead, the financier makes a separate unilateral promise to sell you the car at a nominal or agreed price, or to give it to you after the last rent payment.

Classic residual value versus rent that covers the full price

A conventional lease sets a residual value and lets you buy, return the car or lease another. Lease-to-own ijara spreads the price over the rent, so payments are higher but there is no large final payment.

Mileage, wear and return charges

If the ijara ends with returning the car, check the annual mileage allowance, the excess-kilometre charge and the normal wear guide. These charges should reflect an actual agreed compensation, not a penalty calculated like interest.

Early termination and missed payments

On termination, the contract must state the amount owed and what happens to the car. A halal financier should not charge late interest; some require a donation to charity instead. The Consumer Protection Act also regulates terminating a long-term lease.

Long-term leasing and Québec consumer protection

Québec's Consumer Protection Act governs long-term leasing of goods and requires a written contract stating, among other things, the agreed value of the goods and the obligations at term end. The OPC publishes helpful guides for reading these contracts.

Publishing the lease in the RDPRM, then removing it

In Québec, a vehicle lease longer than one year must be published in the RDPRM to be enforceable against third parties. Once ownership passes at the end of the ijara, have the entry cancelled so you can resell the car freely.

GST and QST charged on each rent payment

With a lease, GST and QST generally apply to each payment rather than the full purchase price. At the final buyout, tax applies to the agreed sale price. Ask for these amounts in the payment schedule before signing.

Car ijara providers to check

Signing a car ijara in Québec in six steps

  1. Decide whether you want to keep the car at the end, since that determines lease-to-own ijara versus returning it.
  2. Ask the provider who owns the vehicle, who registers it and who bears total loss or theft.
  3. Get the rent schedule with taxes, the mileage allowance and the price set in the final sale promise.
  4. Have an advisor or lawyer review the maintenance and termination clauses before signing.
  5. Insure the vehicle as the lessor requires and keep proof of insurance in the car.
  6. After the last rent, sign the sale or gift deed, transfer the registration and have the RDPRM entry cancelled.

What people ask about car ijara in Québec

Can a dealership lease be halal?

A conventional lease usually includes an implicit financing rate and late fees calculated like interest, which many scholars reject. Ijara requires a lessor that truly owns the car and suitable clauses. Have a qualified scholar review the contract.

Can ijara rent change during the contract?

It can be fixed, or adjustable if the formula is known and agreed at signing. Rent already due must never be increased. For a tight budget, a fixed rent gives more predictability.

What happens if the car is stolen during the ijara?

Theft is usually covered by the insurance the lessor requires. Under ijara logic, the owner bears loss of the asset; the contract should say how the payout is shared and whether rent stops.

Can I buy the car before the ijara ends?

Some providers allow it by selling the car to the lessee at a price reflecting the remaining rent. Ask for a written illustration for several possible dates.

Always verify current terms directly with the provider before making a decision.
