Buying a car through murabaha in Canada, from order to final instalment

Car murabaha is a cost-plus sale in which a financier buys the car you have chosen, then resells it to you at a total price known in advance, payable in fixed instalments, with no interest added along the way.

The principle: disclosed cost plus a markup

Murabaha is a sale in which the financier discloses its purchase cost and the markup added. For a car, it buys the vehicle from the dealer, then resells it to you on deferred terms. It is the same mechanism as home murabaha.

Why the financier must own the car before reselling it

According to many scholars, you cannot sell what you do not yet own. The financier must acquire the car, even briefly, and bear its risk before concluding the sale with you. An invoice in its name provides the proof.

When the customer acts as the financier's agent

Some providers appoint you as agent, or wakil, to choose and take delivery of the car on their behalf. That agency must be signed before the purchase, and the sale to you can only follow afterwards, in a second, separate document.

What the contract must show

The contract states the purchase cost, the markup, the total price and the number of instalments. Once signed, the price does not change, even if market rates rise. A sharia compliance certificate gives comfort on the structure.

Car murabaha versus a conventional auto loan: the real difference

A conventional loan charges interest on a declining balance and can be renegotiated; murabaha sets a single debt at signing. Over the same term, total cost may be similar or higher. Always compare the total dollars paid.

Early payment and the optional rebate, ibra

The financier is not obliged to lower the price if you pay early, since the debt is fixed. Several providers nonetheless grant a voluntary rebate called ibra. Ask in writing whether it applies and how it is calculated.

Late payments handled without interest

The price cannot rise when you pay late. To discourage arrears, many contracts include a pledge to donate to charity, which the financier does not keep, and sometimes recovery of actual collection costs.

The security registered on the car until the final payment

Until the last instalment, the financier usually registers security on the car: in the personal property registry in common-law provinces, or the RDPRM in Québec. It is discharged after full payment, which you should confirm before reselling.

Sales tax by province of registration

Sales tax varies: 13% HST in Ontario, GST and QST in Québec, GST only in Alberta, GST plus provincial tax in British Columbia. In a murabaha, ask how tax is handled across the two successive sales.

Who offers car murabaha in Canada

Halal Auto offers murabaha and lease-to-own. Muevmnt says it finances cars nationwide, while Amana Drive, a referral service, says it covers British Columbia, Ontario and Alberta. HalalWallet compares options but does not lend.

New or used: what changes

Murabaha also works for a used car bought from a dealer, provided the financier can inspect and acquire it. Private sales are harder to structure. The guide to used cars without riba covers these cases.

Be wary of murabaha that hands you cash

Some offers have you buy and resell a commodity so you receive cash, known as tawarruq. Many scholars criticise it when its only purpose is obtaining money. For a car, the murabaha should cover the vehicle itself.

Car murabaha steps, from order to discharge

  1. Choose the vehicle and negotiate the price with the dealer without signing its credit contract.
  2. Send the vehicle details and your documents to the halal provider for conditional approval.
  3. If asked, sign the agency mandate authorising you to act as the financier's agent for the purchase.
  4. Let the financier pay the seller and receive the invoice in its name before any sale to you.
  5. Sign the murabaha contract showing cost, markup, total price and a fixed instalment schedule.
  6. Insure the car, register it under provincial rules and keep proof of the registered security.
  7. After the last instalment, request discharge of the security and written confirmation of full payment.

Practical questions on car murabaha in Canada

Can I do a car murabaha with no down payment?

Some providers accept it, others require a first payment to reduce their risk. A down payment lowers the total markup, since it applies to a smaller amount. Ask for illustrations with and without one.

What if the car is damaged during the murabaha?

After the resale you are the owner: the loss is yours and the debt remains due. The insurance the financier requires is there to repair the car or cover the balance. Check that coverage matches what you still owe.

Is car murabaha offered in every province?

The contract can be used anywhere, but actual supply depends on providers and the provinces they serve. Tax, registration and security rules also vary. Check availability in your province before ordering.

Can a self-employed person finance a vehicle through murabaha?

Yes, if income is documented with Notices of Assessment and statements. The tax treatment of the markup for business use should be confirmed with an accountant, since it depends on actual use.

Always verify current terms directly with the provider before making a decision.
